Terms of Service

These terms govern your use of lightshift.ie and any development work carried out by Lightshift, the app development studio inside Everblue Digital, a business registered in Ireland and based at Cavan Digital Hub, Kilmore Business Park, Cavan, Co. Cavan, H12 PD82. By using this site or engaging us for a project, you agree to the terms below. If you have questions before signing anything, email hi@lightshift.ie.
Services and scope
Development work is provided under a written scope or quote agreed with you before any build begins. That document sets out what we are building, the cost, and roughly when it lands. Work outside that scope, including new features requested mid-build, is treated as a change and agreed and priced separately before we start on it.
Quotes and payment
Quotes are valid for the period stated on the quote itself, typically thirty days unless otherwise agreed. Payment terms, including any deposit and milestone structure, are set out in the scope document for each project. Late payment may pause work until the account is brought current.
Intellectual property
Ownership of the code, designs and other deliverables we create for your project transfers to you on full payment for that work, unless the scope document states a different arrangement. Before final payment, or where any part of a fee remains outstanding, that work remains our property. We retain the right to reuse general tools, libraries and know-how developed during a project on other work, provided nothing confidential or specific to you is disclosed.
Third party services
Projects often connect to third party services you hold your own accounts with, such as Stripe, Xero, GoCardless, Supabase, or hosting and email providers. You are responsible for the terms and costs of those accounts. We are not liable for outages, pricing changes or policy changes on platforms we do not operate.
Warranties and liability
We build with reasonable skill and care and will fix defects in delivered work that are reported within a reasonable period after launch, as set out in the relevant scope document. Beyond that, our liability for any claim arising from a project is limited to the fees paid for that project, and we are not liable for indirect or consequential losses. Nothing in these terms limits liability where the law does not allow it to be limited, such as for fraud.
Confidentiality
We treat information you share with us about your business as confidential, and we do not publish client names, case studies or project details without your agreement.
Termination
Either party can end an engagement in line with the notice terms in the relevant scope document. Work completed and any fees due up to the point of termination remain payable.
Governing law
These terms are governed by the laws of Ireland, and any dispute arising from them falls under the jurisdiction of the Irish courts.
